the cab advice is for buyers on the dti or whatever its called nowadays website thr ehole refulation is laid out. which clearly states online auctions are exempt from dsr, buy it now listings are not exempt.
however on auction style listings you must still comply with the sales of goods act.
for those that don't realise there is a huge difference between law & ebay regulations.

You will be glad to know Ebay have ruled in my favour and refunded my money and postage fees. It was only a piffling amount but it was the principle. If the tubes had been advertised as spares or repair I would not have bothered but as they were advertised as used and the official description of this category is "showing some signs of usage but fully functional" and they are not I was not happy to keep them.

Contacted the seller but claimed to be the nephew and his uncle (the seller) was in hospital, but was still managing to sell stuff on Ebay while gravely ill. So after a long series of arguments Ebay stepped in and refunded my money.

2) Where do the Distance Selling Regulations apply?
The Distance Selling Regulations generally apply to sales to non-business buyers made by sellers acting in the course of a business, which have been made at a distance. In other words, where there is no face-to-face contact between the seller and the buyer before the contract is made. The Distance Selling Regulations usually cover sales made over the internet, including:
*
Buy It Now listings on eBay.co.uk
*
Second Chance Offers on eBay.co.uk
The UK Distance Selling Regulations do not apply to eBay auction format listings on eBay.co.uk, and do not apply to all types of items.
