I think the point being made is they could because it's been published. The reality is that trying to sue for invasion of privicy won't be very productive (lawyer's fee accounts aside ) if the image was taken in a public place whilst the photographed was in a public place. May also be arguable if clearly visible without special measures (ie step ladder, tree climbing etc) on private land.

Paperazzi still make a living without being sued because most stick to public areas and the targets are usually all too grateful for the (continuing) interest.
