That's correct Gwyn, but it's the first owner who is selling a used item so he would be responsible for ensuring it is fit for the purpose

Private sales between individuals are not subject to the same laws and regulations, so the only requirement is to describe something fairly and accurately.

What about warrenty the manufacture gives?
The K7 is weather resistance so if it get fried because one of the seals leaked, surely the manufacture can be hold responsible right if you handled the product correctly and haven't damage it or not?

Surely you've heard of Chinese Whispers Stefan? the first owner sells the camera (with no manual) telling the new owner about the weather sealing and claiming the camera has been "soaked" on several occasions, the second user takes this at his word and uses the camera while people are having water fights using buckets of water, he then sells it on the a third owner telling them about the water bucket fight, etc etc etc, eventually someone aquires the camera only to be told it can be soaked in a bucket of waterWhat about warrenty the manufacture gives?

So how does Pentax prove the camera was submerged and the seals are not at fault?
A bit of an extreme example I know, but it does show that manufacturers have to protect themselves from faults which are due to the equipment been used outside the guidelines, which can often happen with second users who may not necesarilly have been given the user manual.

I've no idea and neither can the user but a new user can also be lying that he didn't submerged it so you come at the same case essentially.So how does Pentax prove the camera was submerged and the seals are not at fault?
Surely they must have a way to test it right?
But besides that a manufacture does have responsibilities over the products they make right?
The question was do you lose those rights if you buy second-hand?

Generally within EU (and also in the US) the name and other identities of the buyer is not written on the receipt/warranty documents (unless you do ask for it) and so the factory warranty is valid for the product regardless the actual owner of it. On the other hand the extended warranty provided by some big sellers is usually valid only for the first buyer, but this really depends on the decision of the particular seller.
