Keeping warm - edit

Yesterday I posted a couple of photos for C&C.

I subsequently had the post removed as I found out it would be in breach of French law.

I just wanted to say thanks to those who commented and offered their opinions and make sure that I was not ignoring anyone.

I continue to be inspired by this forum and also to learn (even if the learning is about legal stuff!)

Please enlighten us, so we won't end up behind bars (of the wrong sort) if we go to France .

If you take a photo if someone, with or without their knowledge, you must get written consent from them befire publishing it on the internet.
This only applies if they are recognisable so back of heads are ok as are large crowds i think.
There are exceptions but mainly for news reporters etc.
I believe street photographers over here are having to come up with a different plan!
It'sa shame for me because i thought i was getting better at it ☺

Does the French law not make the distinction between personal and commercial use? If you are not earning anything from the image, nor casting the subject in an unfavourable light then surely that would be ok.

No, as far as I can tell, there is no difference - no written permission, no use of the image. The image belongs to the person/people in it!
