I'd check the battery compartment/clean the contacts. May not be the issue but it's one thing to eliminate

The camera was packed in original packaging and inside another bigger bubble wrapped box..
When buyer recieved packaging was undamaged.
So no visible signs of being dropped.

Sounds like you don't have the camera still? You hadn't said it was one you'd sold on rather than an issue you'd just experienced yourself. So have you witnessed the problem with your own eyes? I ask because I thought I had a similar problem with my Pentax Q on delivery, but I'd put the battery in upside down!
If its been couriered though it may have been dropped, suffered vibration or goodness knows what.
It is even possible the buyer had a dead K-3 and saw you as an opportunity to take their pain. If you haven't witnessed the problem, how do you know how it is in reality? Plenty of scammers use eBay etc. for various reasons, both buyers and sellers.

Probably worth confirming that the battery wasn't put in upside down per Jaks post, Or, and I have no idea if this is possible, can the camera be set to only get power from the grip even though a battery is inserted in the body? If so, was the grip fitted?
If it appears that the buyer knows what they're doing, then just get the camera sent back and give the buyer a refund. Standard eBay process. You'll have to pay return p&p probably but I presume eBay refunds selling fees?

Buyer returned camera and its definitely not powering up but does now have a heavily scratched area in bottom left corner at rear where it may have been dropped !
Trying to prove to ebay now that damage is new.
Where would you send a k3 for inspection?

Seems like it's going to be a tough one to win. Ring eBay customer services and report the case to an advisor. You might even want to contact the correct law department if you feel there is fraud going on (check serial numbers etc.).
Ebay are terrible for sellers when there are returns involved.
