Does anyone know where I stand?

Latest update - It seems that the price has gone up since I bought the camera.

They now expect me to pay the increased difference.

I kind of agree with what John is saying about being honest and building up a relationship with a dealer. We all find it's in our interest in the long run with SRS.

On the other hand, Oggy said in his first post that he has to go miles out of his way to sort this out so at very least I would expect the retailer to arrange for courier (which he may have done?), but from what Oggy has said so far it sounds to me like the dealer is being difficult - they were in the wrong and they will lose out.

As for this ...

I would tell them to 'do one'.

Oggy, if you haven't done already (I may have missed it) - I really think it's time to 'name and shame' this retailer as I for one wouldn't want buy from them

I have reservations about naming them on two grounds-

1/. It could put this fine Forum in an awkward position.

2/. The matter has not been resolved yet.

And this puts pay to John's idea about building a relationship with this dealer.

If they have CCTV ask them for a copy of you buying the camera, they can't legally refuse ( if they still have the recording). That is your proof of purchase, then go direct to Pentax for your warranty.

Well, that's what I'd try.

about #1:
I don't think you have to worry about that. There are more companies who have had bad critiques on this forum. And none of those threads were considered awkward for the forum. Your opinion on this of course shows: You are a real Gentleman.

I have now waited a week for the promised letter after my third attempt to sort the problem, and guess what.

Not a happy bear.

Would one of the Mods/Admin PM me to let me know whether they are happy for me to name the company concerned?

If it makes you feel better, perhaps you can send them an e-mail with a link to this thread, before going public.Maybe that makes them think a bit.

Hope it works out for you.

Martin.
Best regards,

Martin.

Having Got fed up with the whole thing, I wrote to them on 21 Jan suggesting that I brought the whole shooting match back to them for a refund. This would have left me time to buy another K20 elsewhere and just about get the cashback. I have still not had a reply.

The best interpretation I can put on this is that their customer service is awful, and the worst is that they are doing it deliberately to reduce my consumer rights and let the cashback offer expire.

Have you contacted Pentax directly? They may be helpful if you explain the situation and what you have done to try and sort it.

Just a thought.

As Ted says write to Pentax and put them in the picture, then write to your supplier again and tell them they have 7 days to resolve the matter to your satisfaction or you are taking legal advice, send the letter by recorded delivery and include a copy of the letter sent to Pentax.

Point out to your supplier that should thier delay cause you to lose your cashback from Pentax, you would be well within your rights to sue them for the loss.

I have sent all the paperwork I have off to Pentax with a covering letter to try to get the cashback.

I have contacted trading standards who said that given the delay (caused by the supplier) that there is very little I can do.

I will write to Pentax regarding the registration of my gear as I am now concerned that if I had to send it back for warranty repair or service it would come up as a dubious one.

Oggy,

I've been looking at this thread as a new user, and have a couple of comments to make if you don't mind?

First, legally, if the goods were offered for sale at given price and you accepted and paid for them in full at the price offered then the transaction is complete and the shop cannot later change their mind and say they made a mistake. Note that this is different to, for example, a lens costing £1,000 incorrectly being advertised at £100 in a magazine advert or on a website, you providing your credit card details, and the shop/website then refusing to accept your order. They are within their rights here because the sale has not been completed.

Morally, of course, it is up to you to do what you are comfortable with.

On the issue of warranty, provided you have proof of purchase then you warranty will be honoured. Proof of purchase does not necessarily mean a till receipt - for example a page from your visa or bank statement with the transaction showing is sufficient evidence. Worth remembering for if you ever loose a receipt!

The CAB should have been able to tell you much of the above!

Finally, I don't work in the legal field, but have passing experience of contract terms & conditions, so this info is offered 'as is' in good faith. Hope it is of some help...

Regards,

Wilf

Sorry for coming back to this but it has really got my back up!

All you wanted was a reciept that said you bought a K20D, you were well within your rights over this transaction and the retailer damm well knows it, theyre just being bloody minded about it.

Rubbish! you entered into an agreement with a retailer, if the retailer breaks that agreement and through inaction and refusal to sort it out they cause you further loss, then they can be held accountable for that loss.
