Update, still no contact from the guy but checked my bank online today and he has refunded the money!! didn't let me know or anything, money has just gone back in. Maybe it was the email I sent yesterday, mentioning the bank and taking action

Hi, just thought I would update you all, still haven't been able to contact them or heard anything back but been in touch with bank, and basically, after filling out a few forms, they chase it up and reclaim the money from them for us. So, hopefully, we should get it back, and she said it happens all the time, can't believe companies can work and get away with this kind of thing! Thanks for all your help and advice everyone

thanks, to be honest I would be quite happy if they just sent it, its supposed to be for my daughter for Christmas I still havent heard or been able to contact, so we are going out to pcworld tomorrow to get it (to be sure we have it for Christmas) and if it does turn up after that then we will send it back for a refund, that's if we ever hear from them
