Through *most* professional experiences one also has to note where the original photograph was taken and also where it will be published. In most instances; a photograph taken at a public venue can be published without releases if adults are the subjects. I've seen some truly interesting variations of this one

How do you define a public venue?
Do you recognise the difference between say editorial use and commercial use?

A model release has nothing to do with where the photo was taken but where the image is going to be used.

By legal and contract law definitions... One does not need a model release IF it is a photograph of an adult taken at a public venue. Further meaning; if the subject happens to be out in public; ie - on the street, at a public park, outdoors at a café, etc... Not my interpretation, that's simply the way that it is written.

Take one at a public venue, most publishers do not require the release. Further case in point; just for purposes of example, not a literal example... Could be published in Life magazine, The Guardian, etc... Could be used for general story, editorial, or even most forms of commercial use

Having refused to sign a photographer's release form, this woman stands to win a lifetime of Chipotle Mexican meals. If she wins... big if!
