Mobile Wallpaper images

Hi everyone,
Has anyone discovered one (or more) of their pics being made available as a wallpaper download for mobile phones without their consent? What is the position re. copyright?

Anyone offering your work for sale (or even for free) without your permission is guilty of theft, regardless of the intended use, if you find anyone doing this write them a polite letter asking them to cease using the image, also include an invoice for the use they have already had out of the image in question

unless you've given up your rights in the picture, the Copyright Act is on your side and you could choose to take action against those infringing those rights - or at least, as a first move, let them know that they are at fault. But if your photos are being downloaded from a site where you've chosen to host your pictures, it's as well to ensure that you haven't (inadvertently) given up your rights by agreeing to the site's small print. Such conditions might be challenged as being unfair, but that's another hurdle. I'm afraid infringement of (c) is a continuous battle, and understandably most individuals stay clear of it unless their livelihood is being put at risk.

Thank you very much for your replies- one image in particular has been downloaded over 700 times!!! It is on Flickr and Redbubble- I believe copyright remains intact on Flickr. On Redbubble it is one of my best sellers.
