Copyright Question

Last year my mate went on a World cruse on the Aurora cruse ship, I followed him around the World on the web cam on the ship, I did a few print screen's from the web cam, what I want to know is, who holds the copyright on the photos I took off the web cam.

He because he created them, you only copied.
If you upload a photo you have all the rights not the one that download them, it's the same thing basicly.

I disagree with Stefan

This is actually a tricky one, assuming were talking UK law, as I understand this will vary from country to country:

If you take a picture of someone in the UK using their camera, either digital or film, then you are both joint copyright holders, they because they own the equipment and asked (commisioned) you to take the photograph, and you because you composed the picture and pressed the shutter.

The situation of webcams is very similar, they (the webcam owners) are allowing you to see through their equipment and save stills, I suppose the real issue will arise over the wording in the small print that accompanies the agreement to actually use the webcam software in the first place

What I want to know is why are you interested in this? surely you cant have got a money making pic from a webcam?

If you really need to know, then a solicitor specialising in copyright law is the only person whio can give you a proper answer.

Ho Alan wait.
I agree with you with the camera but not with the webcam, it's very differend.
When you take a screenshot, you actually take one frame from a movie someone is uploading with their camera, there isn't any inputt involved from you. You only choice which frame you want to have, nothing more.

Yes if they allow then okay but they need to do that.

What if i make a timelaps film with photos i've taken and upload that and someone takes a frame (one photo) is that then allowed or not???
I don't believe so.

It doesn't matter if it's direct upload or not, so far as I know.
You are the creator of that film and hold the rights over it.

I wasn't 100% either so needed to check.

With film it says this.
Sound recordings and films

(1)In this Part—
“sound recording” means—

(a) a recording of sounds, from which the sounds may be reproduced, or

(b) a recording of the whole or any part of a literary, dramatic or musical work, from which sounds reproducing the work or part may be produced,

regardless of the medium on which the recording is made or the method by which the sounds are reproduced or produced; and “film” means a recording on any medium from which a moving image may by any means be produced.

(2) Copyright does not subsist in a sound recording or film which is, or to the extent that it is, a copy taken from a previous sound recording or film.


As you read it counts for every medium and for every part of the work, so even for one frame.

It only makes me wonder how it works internationally though

Stefan be careful where you stay in Nottingham - you'll find very cheap B&B but probably not in an area you'd want to stay! If you need any help my daughter lives there and would I am sure be able to advise. Personally I haven't ever felt uncomfortable in Nottingham but she assures me I haven't been to the right parts yet!

Thanks for all your replies, P&O ferries provide webcams on all their ships for anyone to view publicly, I took screen prints of most of the ports my mate and his wife called into, I was going to make him up a small photo album of his round the world journey not for resale I only asked in case I was infringing on copyright, thanks again,

I believe that the copyright law is diferend on those things since it isn't considered art, also it stays in the family so

It would be helpfull indeed, it's only for 2 nights and can effort some luxury but it needs to be very reasonable for a student to pay.
I've already a trip a month before that and another one is also in the planning.
