Consent to use image

There was an article in the Times yesterday (2/2/2016) reporting on a dispute involving someone taking a selfie of themself and daughter, in which, in the background, a rather amusing horse was grinning.
The image was subsequently entered into a holiday company's competition. The owner of the horse says that the consent of the owner should have been obtained before the image was used.

Surely they have neigh chance of winning that one ☺

No, I don't think that one has any merit in it.
